Terms of use
These Terms of Use ("Terms") are a legal agreement between you and Bitsick Productions LLC ("Bitsick," "we," "us," or "our"). They govern your access to and use of bitsick.com and any Bitsick-operated websites, applications, games, community features, newsletters, or online services that link to these Terms (collectively, the "Services").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be old enough to form a binding contract where you live to use the Services. In all cases, you must be at least 13 years old to use any account-based, social, or interactive portion of the Services. If you are under the age of majority where you live, your parent or legal guardian must review and agree to these Terms on your behalf.
2. Additional terms for specific products or platforms
Some Bitsick products, betas, communities, storefront listings, subscriptions, or promotions may be subject to additional terms, end-user license agreements, platform rules, or product-specific notices. If those additional terms conflict with these Terms, the additional terms control for that specific product or feature to the extent of the conflict.
If you download or access a Bitsick product through a third-party storefront or platform, that platform's terms, conditions, payment rules, refund policies, and technical restrictions may also apply.
3. Accounts
Some Services may require an account. If you create an account, you agree to:
- provide accurate and current information;
- keep your login credentials confidential;
- promptly update information that changes; and
- notify us if you believe your account has been compromised.
We may suspend, restrict, or terminate accounts that violate these Terms, threaten the security or integrity of the Services, or create legal or operational risk for Bitsick or others.
4. Purchases, subscriptions, and payments
If a Service offers paid features, pricing and payment terms will be presented at the point of purchase. Unless expressly stated otherwise:
- payments are due in the currency and on the terms shown at checkout;
- purchases made through third-party storefronts or payment processors are also governed by those providers' terms;
- refunds are handled according to the applicable storefront policy, payment terms, or mandatory law; and
- subscriptions, if offered, renew only as disclosed at signup and may be canceled through the method identified for that subscription.
5. Limited license to use the Services
Subject to your compliance with these Terms, Bitsick grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for their intended purpose.
Except as expressly allowed by these Terms, a separate written license, or applicable law, you may not:
- copy, distribute, sell, rent, lease, sublicense, or commercially exploit the Services;
- modify, translate, adapt, reverse engineer, decompile, or attempt to extract source code except where applicable law prohibits that restriction;
- circumvent or interfere with security, authentication, rate limits, or access controls;
- scrape, harvest, or systematically collect data from the Services by automated means without written permission;
- remove copyright, trademark, or proprietary notices; or
- use the Services in a way that could damage, disable, overburden, or impair them.
6. User content and community features
Some Services may let you create profiles, post recommendations, send messages, upload content, or participate in community features ("User Content"). You retain ownership of User Content you create or submit.
By submitting User Content through the Services, you grant Bitsick a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify solely for technical formatting, display, perform, distribute, and otherwise use that User Content only as needed to operate, provide, maintain, back up, and improve the relevant Service and its community features.
You are responsible for User Content you submit and represent that you have the rights necessary to submit it.
7. Feedback
If you send us ideas, suggestions, bug reports, or other feedback about the Services, you grant Bitsick a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, copy, modify, publish, and otherwise exploit that feedback for any lawful purpose without compensation or obligation to you.
8. Ownership and intellectual property
The Services, including their software, design, text, graphics, audiovisual content, branding, and other materials, are owned by Bitsick or its licensors and are protected by intellectual property and other laws.
Except for the limited rights expressly granted in these Terms, no rights are granted to you by implication, estoppel, or otherwise.
9. Acceptable use
You agree not to use the Services to:
- violate law or another person's rights;
- harass, abuse, threaten, stalk, or impersonate others;
- post or transmit defamatory, fraudulent, deceptive, infringing, or unlawful material;
- send spam, unsolicited promotions, or manipulative engagement;
- probe, scan, or test vulnerabilities without authorization;
- distribute malware or interfere with the security or operation of the Services; or
- use the Services in a way that is misleading about affiliation, endorsement, or ownership.
10. Third-party services and open-source software
The Services may integrate with or link to third-party services, stores, payment processors, authentication providers, streaming services, community platforms, or other websites we do not control. Your use of those services is governed by their own terms and policies, not these Terms.
Some Bitsick software may include open-source or third-party software components subject to separate license terms. Where required, those separate licenses will apply to the relevant components.
11. Beta features and roadmap information
Bitsick may offer pre-release, prototype, preview, early-access, or beta features. Those features may be incomplete, unstable, or subject to change or removal at any time.
Any statements we make about future plans, release targets, features, or roadmap items are informational only and are not binding commitments.
12. Suspension and termination
You may stop using the Services at any time.
Bitsick may suspend or terminate your access to some or all of the Services, with or without notice, if you violate these Terms, create legal or operational risk, or if suspension is necessary for security, technical, legal, or operational reasons.
13. Disclaimers
To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. Bitsick disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and quiet enjoyment.
14. Limitation of liability
To the fullest extent permitted by law, Bitsick and its owners, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to the Services or these Terms.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
15. Indemnification
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Bitsick and its owners, officers, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, judgments, awards, losses, costs, and expenses arising out of or related to your User Content, your misuse of the Services, your violation of these Terms, or your violation of any law or another person's rights.
16. Copyright complaints
If you believe content on a Bitsick Service infringes your copyright, send a notice to hello@bitsick.com that includes enough information for us to identify the work you believe has been infringed, the material you want us to review, and how to contact you.
17. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will post the revised Terms and update the effective date above. If required by law, we will provide additional notice.
